These Terms of Service ("Terms") govern your use of the Dividends mobile application (the "App") operated by Dividends Wellness LLC, a Connecticut limited liability company ("Dividends," "we," "us," or "our"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 17 years old to use the App. By creating an account, you represent that you are 17 or older.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@dividendswellness.com if you suspect unauthorized access.

You may delete your account at any time from within the App (Settings → Delete account). We may suspend or terminate your account if you violate these Terms or engage in activity that harms other users or the service.

3. The App Is Not Medical Advice

The App provides general skincare tracking, educational content, and AI-generated guidance based on information you provide. The App is not medical advice and is not a substitute for professional medical judgment, diagnosis, or treatment.

Specifically:

  • Information in the App, including AI-generated responses, is for educational and tracking purposes only.
  • If you experience persistent irritation, unusual reactions, or any skin condition that concerns you, consult a licensed dermatologist or healthcare provider.
  • Do not rely on the App to diagnose or treat any medical condition.
  • We do not guarantee the accuracy, completeness, or usefulness of any information in the App, including AI-generated content.

4. AI-Generated Content

The App uses AI to generate personalized guidance. AI can be wrong. AI-generated content may contain errors, outdated information, or recommendations that are not appropriate for your specific situation. Use your own judgment and consult a professional when in doubt.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose.
  • Impersonate anyone or misrepresent your identity.
  • Upload photos or content that violate the rights of others, including intellectual property or privacy rights.
  • Attempt to reverse-engineer, decompile, or circumvent any security feature of the App.
  • Use the App to harass, threaten, or harm others.
  • Use automated means (bots, scrapers) to access the App.

6. Your Content

You retain ownership of any content you upload to the App, including photos. By uploading content, you grant Dividends a limited, non-exclusive license to store, display, and process that content solely to provide the App's functionality to you. We do not use your content to train AI models or share it with other users.

7. Intellectual Property

The App, including its design, code, logos, and written content, is owned by Dividends Wellness LLC and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute any part of the App without our written permission.

8. Third-Party Services

The App integrates with third-party services (including Supabase, Anthropic, Apple, and Klaviyo). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIVIDENDS WELLNESS LLC, ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PRECEDING TWELVE (12) MONTHS, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Dividends Wellness LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or your violation of the rights of a third party.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the App ends immediately.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Connecticut, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email. Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
